Conducting qualitative research, especially in areas considered ‘sensitive’, presents many challenges. The processes involved in such research often expose both participants and the research team to a vast array of risks, which may cause damage to their personal, professional, social and cultural worlds. Historically, these risks have been considered independent of each other, with most studies exploring only the risks to participants or only risks to researchers. Additionally, most researchers only consider risks during data collection, frequently overlooking risks that might (...) be present during other phases of the research project. We aim, therefore, to bring together this fractured literature to enable an integrated exploration of the current academic discourse relating to risks to participants with the literature exploring risks to researchers across all phases of the research process. This article draws on personal experiences to highlight ethical issues and risks encountered by both participants and researchers throughout all phases of a research project. Beginning in recruitment, we discuss the risk of secondary distress in participants arising from researcher contact and then explore the concept of informed consent during grief and bereavement research. We then focus on risks present during data collection, examining risks for participants, such as emotional distress, and potential safety risks for the research team. Finally, we consider the risks which arise in data analysis, including both confidentiality and the possibility of researcher burnout. Previous recommendations are summarised, with new management strategies suggested based on lessons learned along the way. (shrink)

In this article my aim is to see Karl Llewellyn as a member of the central pragmatist canon. Further, I see Llewellyn not only as a “Legal Pragmatist,” but also as developing a full pragmatist philosophy of law. Reading Llewellyn as a pragmatist would greatly add to an extended understanding of early pragmatism. This would show a strong influence of pragmatic thought within the legal academy.. Second, adding Llewellyn to the pragmatist canon would help show pragmatism in action in the (...) world. Llewellyn might be the central theoretical pragmatist of modern US Law. If, as I believe, pragmatism is a philosophy that depends upon an underlying experimentalist attitude towards philosophizing, given his great influence on US law adding Llewellyn brings a large amount of experimentalist data to the tradition. Fact checking has become a prominent facet of political news coverage, but it employs a variety of objectionable methodological practices, such as treating a statement containing multiple facts as if it were a single fact and categorizing as accurate or inaccurate predictions of events yet to occur. These practices share the tacit presupposition that there cannot be genuine political debate about facts, because facts are unambiguous and not subject to interpretation. Therefore, when the black-and-white facts—as they appear to the fact (...) checkers—conflict with the claims produced by politicians, the fact checkers are able to see only (to one degree or another) “lies.” The examples of dubious fact-checking practices that we discuss show the untenability of the naïve political epistemology at work in the fact-checking branch of journalism. They may also call into question the same epistemology in journalism at large, and in politics. (shrink)

Supporting students to develop transferable skills and gain employment is a vital function of Universities in the era of the Fourth Industrial Revolution. A key area is work readiness, which has steadily grown in importance over the last 2 decades as tertiary institutions increasingly aim to produce graduates who perceive and are perceived as work ready. However, a large majority of graduates report a lack of skills and confidence needed for the effective transition from study to work. This may be (...) particularly problematic for disciplines that impart both discipline-specific and transferrable skills, such as psychology. The aim of this paper is to addresses the concept of work readiness within Australian psychological training and explores the need to shed light on and integrate work readiness within the pedagogy of psychology within Australia. Specifically, this paper calls for a review of work readiness skills developed in psychological courses to ensure industry needs are met. Beyond such a review, it is suggested that tertiary centres need to facilitate students in capturing and reflecting upon the transferable skills that they develop; and build assessments that allow students to demonstrate transferable skills in a meaningful way. Further, this paper proposes that work readiness skills be routinely mapped onto graduate attributes and course learning outcomes to be readily available by students so as to increase students’ potential to articulate their learnt work readiness skills once in the workplace. Out of all the feminist theorists you both interrogate, she seems to emerge as a kind of touchstone of the feminist ethical, political, and intellectual concerns to which you (...) seem to aspire. Could each of you briefly outline how she figures in your work, whether your relations to her have changed, and if so, how?JB:I think that probably early on, when I started working on French feminism as a graduate student in the early ‘80s, I was not interested in her at all because she seemed to me to be an essentialist and that was a term we used quite easily then, when we thought we knew what it meant. In the late ‘80s, I started to rethink my objections to her on that basis and found that she was, among the feminist theorists I had read, perhaps the most versed in philosophy and that her engagement with philosophy was a curious mixture of both loyalty and aggression. And it became very interesting to me when I started thinking about her whole practice of critical mimesis—what she was doing when she was reading Freud, what was she doing when she was reading Plato—and I read Speculum again and again, frightened by its anger, compelled by the closeness of the reading, confused by the mimetism of the text. Was she enslaved to these texts, was she displacing them radically, was she perhaps in the bind of being in both positions at the same time? And I realized that whatever the feminine was for her, it was not a substance, not a spiritual reality that might be isolated, but it had something to do with this strange practice of reading, one in which she was reading texts that she was not authorized to read, texts from which she was as a woman explicitly excluded or explicitly demeaned, and that she would read them anyway. And then the question is: what would it mean to read from a position of radical deauthorization in order to expose the contingent authority of the text? That struck me as a feminist critical practice, a critical reading practice that I could learn from, and from that point on, highly influenced by both Drucilla’s work and Naomi Schor’s work [see Schor], I started to read her quite thoroughly.PC:Is this kind of relationship that she has with the philosophers she reads a sexual relationship? I am thinking of some of the sexualized terms you just used: loyalty and aggression.JB:Yes, there is no doubt that there is an eros of a certain kind, usually the kind that frightens me, quite frankly. I think Carolyn Burke has made this argument that Irigaray [End Page 19] has a romance with the philosophers [see Burke]. I think she has a certain masochistic-sadistic erotic engagement with the philosophers.EG:Do you think it is sado-masochistic?JB:Well, I think it was much more aggressive in Speculum of the Other Woman than it became in An Ethics of Sexual Difference. Richard Rorty believes that the combination of ironism and poetic impulse when attached to the public/private distinction, creates an opening for a type of liberalism that satisfies both the urge for individuality and the urge for solidarity. Rorty's antirealistic pragmatism leads to a society functioning very much like our own. This Dissertation dredges out some of the very contentious underlying assumptions of what Rorty feels is a philosophy-less vision. The ironic poet is Rorty's paradigm of correct modern character. Portraying this (...) poet clearly will bring out what a powerful and radical, yet paradoxically rigidly conservative, outlook he would have us adopt. ;The journey for the outlines of the poet's personality takes me through an investigation of Rorty's interest in Heidegger. While Heidegger's poet can be described in some way as a discoverer , Rorty's poet cannot. From these differing conceptions of the poet I jump to the is/ought distinction as characterized by Hume and reversed by Rorty. I argue that Rorty believes that a fact can only be found within an 'ought.' Utopianism becomes then the only legitimate hope for change. The poet becomes the ultimate option-creator. ;Next is examined Rorty's distinction between the private and public realms. The poet, in Rorty's conception, must speak and create within these two vastly divergent realms. Liberalism and its attendant base upon the isolated and transcendent individual becomes clearly to the forefront here as a grounding point . Habermas and Feyerabend are used to further characterize possible aspects of the poet. I characterize the ironist poet as a reluctant dadaist because of the limits the strong attachment to liberalism places upon him/her. ;Ultimately Rorty's central assumption that the public and private realms absolutely cannot be harmonized in one complete 'overlying' vision that does justice to both is critiqued and questioned. Philosophical Pragmatism and International Relations bridges the gap between philosophical pragmatism and international relations, two disciplinary perspectives that together shed light on how to advance the study and conduct of foreign affairs. Authors in this collection discuss a broad range of issues, from policy relevance to peacekeeping operations, with an eye to understanding how this distinctly American philosophy, pragmatism, can improve both international relations research and foreign policy practice.

Through an analysis of the US Supreme Court's case Heller this paper argues that legal process can be pragmatically reconceptualized so as to create information necessary to decide complex social issues. This is in contrast to other more standard conceptions of law as more emphasizing what information ought to be excluded.

In this paper, I aim to show that the arguments offered and conclusions at which Rawls aims in his book, The Law of Peoples, are telling as to the intellectual legitimacy of his larger theoretical project. To show this I first investigate how (1) non-liberal peoples fit within the limitations Rawls describes in The Law of Peoples and (2) how liberal peoples would react to such rules. I argue from the answers to these questions to the further conclusion that by (...) spreading the principles and tools of A Theory of Justice and Political Liberalism to the international realm some assumptions implicit in the earlier works come out more clearly. The final section of the paper analyzes some of the implications of the newly exposed assumptions for Rawls's project of liberal justice. (shrink)
